On the agenda this week: the Department for Health publishes ‘the year’, NHS Chief Executive Sir David Nicholson’s annual report for 2011/12, time is running out for those wishing to nominate their colleagues in the NHS Leadership Recognition Awards, and the NHS patient feedback challenge expert panel is announced.


The Year 2011/12 – NHS Chief Executive’s Annual Report Published

The Year 2011/12 launched today at the annual NHS Confederation Conference and Exhibition. This is the annual report for 2011/12, in which Sir David Nicholson reviews the NHS achievements of the previous 12 months and considers the challenges to come.

This edition includes The Quarter, which provides the definitive account of how the NHS is performing at national level against the requirements and indicators set out in the NHS Operating Framework 2011/12.

In his introduction to The Year Sir David acknowledges the hard work and diligence of NHS colleagues, with the service now fully committed to delivering the Quality, Innovation, Productivity and Prevention (QIPP) efficiency savings.

Against a backdrop of massive organisational change, Sir David praises, ‘the heroic efforts made by the 1.2 million staff who work for our patients in the NHS.’ Together, they have delivered key successes, including the lowest infection rates since the introduction of mandatory surveillance, lower waiting times for A&E, cancer care and dentistry, and the delivery of £5.8 billion QIPP savings.

Update To Accelerating The Release Of Surplus Public Sector Land


A letter sent to the NHS updates them on their contribution to accelerating the release of surplus public sector land initiative and provide further information on the assistance available to them. This follows the government’s publication of a progress report relating to the ambition to release enough surplus land for 100,000 homes by 2015 on the 7 May 2012.

Support for the NHS in identifying and delivering surplus land is available through the build now, pay later and ATLAS (Advisory Team for Large Applications) schemes. In addition, assistance from the Homes and Communities Agency (HCA) directly may also be available.

NHS organisations are also asked to add their surplus property to the register of surplus public sector land which is now part of the government’s e-PIMS property data base.

Transfer Of Employees From NHS Commissioning Board Authority To NHS Commissioning Board Consultation Summary


This is a summary of the consultation, which the Department of Health undertook between 30 April and 25 May 2012 on the abolition of the NHS Commissioning Board Authority and the transfer of its staff to the NHS Commissioning Board.

As part of the process of abolishing the NHS Commissioning Board Authority and the transfer of its staff to the NHS Commissioning Board, the Department was required, in accordance with section 28(7) of the NHS Act 2006, to consult representatives of those staff whose employment may be transferred, or who may be affected by such transfers.

Maintaining NHS Emergency Preparedness, Resilience And Response Staff Capability During Transition


Lyn Simpson, Director of NHS Operations, on behalf of Ian Dalton, Chief Operating Officer NHS Commissioning Board Authority (NHS CBA) has written to SHA and PCT cluster chief executives, and NHS CBA Regional Directors setting out expectations for maintaining NHS resilience going forward.

The letter provides direction of how resilience to respond to incidents must be maintained during transition.

Minister Hails Progress On Health And Safety Regulatory Reform


Getting rid of regulations won’t undermine the UK’s good record on health and safety but will improve its bad record on red tape, said Employment minister Chris Grayling, as he launched a progress report on implementation of the Government’s health and safety reforms.

Health And Social Care Act Explained


A series of factsheets on the Health and Social Care Act 2012 explain particular topics contained in the Act, including its key themes. They include case studies of the policy in action, or answer frequently asked questions about the topic.

The factsheets were first published in October 2011 and have since been updated to reflect the changes made during the Act’s Parliamentary passage.

Another Death And More Enforcement Action In Legionnaires’ Outbreak


A second person has died in the Edinburgh outbreak of Legionnaires’ disease but the Scottish Government has repeated reassurances that the worst is over.

A man in his 40s, who was suffering from significant pre-existing underlying health conditions, died yesterday evening at the Edinburgh Royal Infirmary. The man is understood to have been from the Gorgie area of the city, which is currently the focus of the investigation into the source of the outbreak by the HSE and Edinburgh City Council.

The latter announced this afternoon (15 June) that it has served an Improvement Notice on the National Museum of Scotland as part of the on-going investigation. It relates to staff training issues and requires the Museum to ensure that key personnel are appropriately trained in the management of water systems, which includes overseeing the on-going monitoring and maintenance regime undertaken by specialist contractors.

Structural Reform Plan


The Department has published the June monthly progress report on its Structural Reform Plan.
The publication is part of a commitment across Government to promote transparency and accountability and to allow people to check that departments are meeting their commitments.

Surveys Published On Public Perceptions Of The NHS And Social Care, And NHS Staff Attitudes


The Department of Health (DH) has published two separate surveys, one on the public perceptions of the NHS and social care, and the other on NHS Staff attitudes. Fieldwork for both surveys took place towards the end of 2011.

Public Perceptions of the NHS and Social Care is a regular survey that provides a useful check on public sentiment and experience relating to the NHS and social care. The study has been running at regular intervals since spring 2000. It is commissioned by DH and conducted by Ipsos Mori. The results of the study form an overall picture, as perceived by the public, of the NHS and social care. Core questions are asked in each wave of the survey, but there is flexibility that allows us to ensure that the survey reflects the most current issues facing the NHS.

This survey complements other major surveys commissioned by DH but is unique in the fact that it focuses on the general public, rather than patients only, and therefore provides an independent view on how key NHS and social care issues are regarded by the public.

Directions On The Transfer Of Patient Safety Function To The NHS Commissioning Board Authority


These Directions came into force on 1 June 2012.

The Directions to the National Patient Safety Agency (NPSA) have been amended to reflect the transfer of the NPSA’s patient safety function to the NHS Commissioning Board Authority (NHS CBA) on 1 June 2012.  The Directions to the NHS CBA have been amended to reflect the Authority’s responsibility, from 1 June 2012, for the patient safety function previously undertaken by the NPSA.

Guidance On Planning For Property And Estates Transfers Issued


The Department of Health has set out the actions, and timing, required from Primary Care Trusts to prepare for the transfer of property to successor bodies on 31 March 2013.

The key steps for PCTs in the run up to transition are to:

  • identify all property and legal charges that will need to be transferred and recorded in Property Transfer Schemes
  • identify all other assets, rights and liabilities that will need to be transferred and recorded in Property Transfer Schemes. This will include identifying not only assets held such as equipment and IT but also identifying options, overages, grant agreements, development agreements, warranties and guarantees given.
  • provide any other information that is essential to the transfer of ownership of estate to facilitate operation and management without causing disruption to services provided.
  • transfer estate without disruption to services provided.



Serious Fire-Safety Breaches Cost ASDA


National food retailer Asda Stores Limited has been ordered to pay more than £55,000 in fines and costs for committing serious fire-safety breaches at a store in Berkshire.

Appearing at Reading Crown Court on 6 June, the firm pleaded guilty to two charges brought under the Regulatory Reform (Fire Safety) Order 2005. The case had received an earlier hearing in February at Reading Magistrates’ Court, but was referred to the Crown Court, where a number of further charges were brought into account.

Royal Berkshire Fire Authority (RBFA) brought the charges following an inspection of Asda’s store in Cippenham, near Slough, by fire-safety officers on 24 June 2010. The court heard that the breaches presented a serious and life-threatening risk, not only to the staff who worked in the store but also to customers and other members of the public.

Counsel for the prosecution, William Clegg QC, told the court that the inspection, which was carried out following a complaint, identified serious breaches to fire-safety regulations, including:
  • two fire-exit doors chained and locked shut;
  • obstruction of fire-escape routes;
  • combustible items obstructing fire-exit doors and escape routes; and
  • fire-exit doors wedged open.

The court also heard that the company had previously been served with a caution in July 2000 for two contraventions relating to other fire-safety regulations.

NHS Trust Saves £82k on Gas Bills


The Worcestershire Health and Care NHS Trust saved thousands of pounds on its gas bills this year after its supplier billed the energy consumption incorrectly.  The Trust was apparently charged double for the gas for one of its buildings, according to the energy management bureau from TEAM which spotted the mistake. It says the Trust saved £82,104 on its bill for the Isaac Maddox House, which sits next to the Worcester & Birmingham Canal.

Guidance Aims To Improve Procurement Across Healthcare System


Guidance aimed at improving procurement across the healthcare system has been published by the Department of Health.

‘NHS Procurement: Raising Our Game’ sets out proposed actions for NHS trusts and the Department and focuses on taking immediate action to start tackling six key areas for improvements:
  • levers for change
  • transparency and data management
  • NHS standards of procurement
  • leadership, clinical engagement and reducing variation
  • collaboration and use of procurement partners
  • suppliers, innovation and growth

This guidance is launched in advance of a procurement strategy planned for later in 2012 that will be developed following a wider call for evidence. It aims to start the journey to world class procurement by identifying those issues and actions that require immediate attention in order to lay the foundations for a fuller and further-reaching strategy later in the year.

In support, we are also publishing NHS Standards of Procurement, which will support trusts in understanding what good procurement looks like and in planning their improvements at a local level.  The standards can be used to identify what a trust’s areas of strengths and weakness are in their procurement and suggest ways in which they can start to monitor and measure improvements.

Further Evidence On Market-Facing Pay Published


More written evidence on market-facing pay has been published by the Department of Health.

The Chancellor of the Exchequer wrote to the Senior Salaries Review Body (SSRB) on 7 December 2011 asking it to consider how to make pay more market-facing for NHS very senior managers (VSMs).

On 23 December 2011 the Secretary of State for Health wrote to the SSRB confirming the remit and setting out the work required. The SSRB issued a call for evidence to enable them to carry out this work.  The evidence argues that there is a national market for this small group of key leaders of national organisations. The introduction of market facing pay for VSMs would risk limiting the pool of available talent and jeopardising recruitment to these key roles.

The new pay framework for VSMs about to be published is based on national pay rates with flexibility to respond to local conditions and the Department believes that this is the right approach for VSM pay.

Health & Safety Executive - CDM Regulations To Be Rewritten For 2014


The HSE has announced it will be re-drafting the Construction (Design & Management) Regulations for reissue in 2014.  A representative from the regulator confirmed the plans at an event held by the Association for Project Safety in May.

Details will be presented to the HSE board in December 2012. However, the Executive indicated that the new Regulations are likely to be based more closely on the requirements of the EU Temporary or Mobile Construction Sites Directive.

DoH Corporate Plan 2012-13


The Department of Health’s Corporate Plan sets out our priorities for the year ahead. The Department’s enduring purpose is to achieve better health, better care, better value: working to help people live better for longer.

Now that the Health and Social Care Bill has become law, the Department has a firm platform on which to build clarity about the future direction of the health and social care system as a whole. 
The plan groups the Department’s activity into six priority areas:


  • Better health; Better care; Better value relate directly to DH’s enduring purpose and capture the key business priorities for the Department for this year to April 2013
  • Successful change, delivering the transition to the new system – picks up the work the DH does and its accountability for making this happen
  • Working with our partners – builds on what the DH does now and recognises that in the new system the Department will be working differently
  • Transforming the DH itself – is about the DH’s journey to develop its capability.

The plan is also built around how the Department will support the Secretary of State to deliver his five strategic objectives:

  • a patient-led NHS
  • delivering better health outcomes
  • a more autonomous and accountable NHS
  • improved public health
  • reforming long-term and social care.

Details Of Potentially Surplus Land For Housing In The NHS Published


Details of potentially surplus land for housing, currently owned by NHS organisations, which is no longer required nor likely to be needed for health service purposes in the future have been published. The information was provided by each of the 399 NHS trusts in England to the Department of Health through a central data collection.

The main findings from the 2012 data collection from NHS trusts, which related to parcels over 0.25 hectares, include:

  • of the total 399 NHS trusts, 188 (47 per cent) declared at least one parcel of surplus or potentially surplus land and 211 (53 per cent) gave a nil response
  • a total of 414 separate parcels of land were identified by the 188 NHS trusts who declared surplus or potentially surplus land.

The results provide an update to the information published in October 2011 by the NHS and the Department of Health on the Disposal strategy – Land For housing. The information will assist in quantifying the contribution of the NHS to the on-going government initiative of accelerating the release of public sector land for development.  The data collection used to compile these statistics was undertaken during January and February 2012 and the statistics relate to information available as at 1 January 2012.

Safe Management Of Healthcare Waste


An updated version of the safe management of healthcare waste guidance manual is published.  A number of issues needed clarifying to improve consistency of understanding and to advise of legislative changes that have come into force since publication. The changes are:
  • a change of wording from premises notification to premises registration
  •  a paragraph has been inserted on the Waste Framework Directive 2011 which came into force after publication
  •  Controlled Waste Regulations 2012 came into force 6 April 2012 – this needed a revised note added  links needed amending from the Carriage of Dangerous Goods Pressure Equipment Regulations 2004 version to 2009 regulations
  •  inconsistency of terminology i.e. sharps boxes, sharps containers, sharps receptacles etc. have changed to sharps receptacles for consistency
  • other amends were of in a similar vein.

HSE Report: Seven Survive Concrete Collapse At John Moores University


Seven construction workers were lucky to survive when more than 250 tonnes of wet concrete collapsed at Liverpool John Moores University, a court has been told.

Quality Accounts Audit Guidance Published

The Quality Accounts audit guidance sets out what trusts will need to do to support the audit of their 2011/12 Quality Accounts.  The audit requirement applies to all NHS acute and mental health trusts that produce a Quality Account for 2011/12, as well as the Isle of Wight PCT.  A Quality accounts Toolkit which provides detailed information about producing a Quality Account. Health Secretary Explains New Health And Social Care Act

Health Secretary Andrew Lansley has set out what the Health and Social Care Act will mean for four key health and care organisations and their staff – clinical commissioning groups, NHS foundation trusts, NHS trusts and local authorities.

He explains there are two simple principles at the heart of the Act – that patients should share in every decision about their care and those responsible for patient care should have the ‘freedom and power to lead an NHS that delivers continually improving care’.

To help save money, improve sustainability and to meet future legislation Stockport NHS Foundation Trust near Manchester has replaced its food macerators with two food waste digesters.

NHS Performance Framework – Implementation Guidance Available


The NHS Performance Framework sets out the Department's approach to identifying underperforming NHS organisations and stipulates when intervention should occur in such organisations.

This implementation guidance is designed to support the application of the Framework. Specifically it:
  • informs NHS organisations of the criteria against which their performance will be assessed – underpinned by the NHS Operating Framework and input from regulators, as well as the frequency of assessment and escalation measures.
  • informs Strategic Health Authorities (SHAs) as the regional system managers and Primary Care Trusts (PCTs) as the local commissioners of NHS services of when they should intervene to address poor performance
  • informs the NHS as to how performance management will be aligned and integrated with the Tripartite Formal Agreement (TFA) monitoring process for NHS trusts, both in terms of scoring and escalation.

HSE Report: Cleaning Firm Fined Over Porter's Death At Royal Bolton Hospital.


A national cleaning company has been fined £175,000 after a hospital porter was killed by an industrial waste compactor in Bolton.

Peter Bonomy's neck was broken when the lid on the large metal container slammed down on him at the Royal Bolton Hospital in Farnworth in 2006.

His employer, ISS Mediclean Ltd, was prosecuted by the Health and Safety Executive (HSE) after an investigation found the company had allowed porters to load the waste compactor in an unsafe manner.

Guidance On Future Ownership And Management Of PCT Owned Estates


The guidance published does not cover existing arrangements, but provides guidance on accounting implications of the transfers of primary care trust (PCT) estate taking place upon PCT abolition.

Subject to the passage of the Health and Social Care Bill through Parliament. PCTs will be abolished in April 2013, requiring the development of new policies in respect of the PCT estate.

The Chancellor of the Exchequer: Just A Sixth Of H&S Regulation To Be Left Untouched


The Chancellor has promised that 84 per cent of health and safety regulation will be scrapped or improved, according to this year’s Budget.  

Last year, in its response to the Löfstedt review, the Government said it is committed to reduce health and safety regulation by more than half. The latest figure announced in the Budget takes into account last year’s Red Tape Challenge, which asked the public and business for their suggestions on which laws could be amended, or revoked entirely.

NHS Staff Survey Results: Stress Remains High Among Nursing Staff


Nearly a third of health-care workers suffered from work-related stress last year, prompting speculation that on-going organisational change in the NHS is having a detrimental impact on employee well-being. Findings from the ninth annual NHS staff survey revealed that 30 per cent of NHS staff reported they had experienced stress related to their jobs last year – a rise from 29 per cent in 2010 – while, among ambulance staff, the figure hit 34 per cent. The latter are also more at risk from physical violence. Overall, 8 per cent reported experiencing physical violence from patients, their relatives, or other members of the public in 2011 – but this figure shot up to 20 per cent among ambulance-trust employees, and 12 per cent among staff in mental-health trusts……

HSE Report: Demolition Firm Sentenced Over Asbestos Danger


A demolition firm has been sentenced after knocking down a building in the Lake District containing hundreds of asbestos ceiling tiles, putting the lives of workers and local residents at risk.

IBT Contracting Ltd was prosecuted by the Health and Safety Executive (HSE) after carrying out the work at a former photography factory in Staveley near Kendal during August and September 2011, despite not having a licence to remove asbestos.

Kendal Magistrates' Court heard IBT had been given a survey by the owners of the site ahead of the work taking place, which stated that the building contained 166 square metres of asbestos ceiling tiles.  But the company failed to arrange for a licensed contractor to remove the tiles safely, and instead released deadly asbestos fibres into the air during the building's demolition.

The results of the 2011 NHS staff survey have been published today. A total of 250,000 NHS staff were invited to participate by postal questionnaire. We received responses from 134,967 staff, a response rate of 54%

Pay Circular On Agenda For Change - Pay Rates From 1 April 2012


The NHS Employers organisation has published the new pay rates for staff on Agenda for Change contracts, effective from 1 April 2012.
The Government has confirmed that staff earning up to £21,000 per year will receive a flat rate pay increase of £250 from 1 April 2012. Other staff will be subject to the two-year pay freeze announced in the emergency budget in June 2010.

HM Treasury: Hutton Review Of Fair Pay In The Public Sector


Will Hutton has published the Final Report of his Independent Review into Fair Pay in the Public Sector, along with his recommendations to the Government.

He was commissioned by the Prime Minister and the Chancellor in June 2010, to make recommendations on promoting pay fairness in the public sector by tackling disparities between the lowest and the highest paid in public sector organisations. Mr Hutton has now presented recommendations for a Fairness Framework for Senior Public Service Pay.
